Terms of Service
Last updated: October 11, 2026
These terms govern your use of Disputivo. By creating an account or using the service, you agree to them. If you're using Disputivo on behalf of a business, you agree to them on that business's behalf and confirm you have authority to do so.
1. Who we are
Disputivo is operated by Sergio Ibarra, a sole proprietorship based in Fullerton, California ("Disputivo," "we," "us"). Mailing address: 3801 Franklin Ave, Fullerton, CA 92833. Email: trydisputivo@gmail.com.
2. What this service is
Disputivo provides administrative tools to help merchants organize evidence for payment disputes: logging dispute details, tracking an evidence checklist, viewing a readiness score, drafting a response letter, and generating an evidence packet.
Disputivo is not a law firm and does not provide legal, financial, or compliance advice. It does not process payments, does not submit anything to a card network, bank, or payment processor on your behalf, and does not guarantee the outcome of any dispute. The readiness score measures how complete your checklist is — it is not a prediction that you will win. Decisions about whether and how to respond to a dispute are yours.
3. Early-access (beta) service
Disputivo is an early-stage product offered as a free beta. Features may change, be limited, or be removed, and the service may be unavailable at times or discontinued. If we discontinue the service, we'll make reasonable efforts to give you advance notice by email so you can download your evidence packets and files.
We do not currently keep backups of your data. Information or files you store in Disputivo could be lost because of a technical failure or other event. Keep your own copies of all evidence, packets, and dispute records, and do not rely on Disputivo as your only record.
4. Your deadlines are your responsibility
Dispute response deadlines are set by card networks, banks, and payment processors, not by us. Any deadline, reminder, or status shown in Disputivo is based on information you enter and is provided for convenience only. You are responsible for confirming each deadline with your payment processor and for submitting your response on time through your processor's own channels.
5. Accounts
You must be at least 18 and using Disputivo for business purposes. You're responsible for keeping your login credentials secure, for all activity under your account, and for providing accurate information when you sign up. Tell us promptly if you believe your account has been accessed without permission.
6. Acceptable use
You agree not to:
- Use the service for any unlawful purpose, or to create, alter, or submit false, misleading, or fraudulent evidence to a card network, bank, or payment processor.
- Upload content you don't have the right to share, or that infringes someone else's rights.
- Attempt to access another user's account or data, or probe, scan, or test the service's security without our written permission.
- Interfere with or disrupt the service or its infrastructure, or upload malware.
- Reverse engineer, copy, or resell the service without our permission.
7. Data you must not upload
Disputivo is not designed to store payment card data or other highly sensitive information. Do not upload or enter:
- Full card numbers, card security codes (CVV/CVC), PINs, or magnetic-stripe or chip data. Last-four digits, and the match results your processor shows (for example "AVS: match" or "CVV: match"), are fine.
- Bank account or routing numbers.
- Social Security numbers, driver's license or passport numbers, or other government ID numbers.
- Health or medical information.
8. Your content and your customers' information
You retain ownership of the dispute information, evidence files, notes, and draft responses you put into Disputivo ("your content"). You give us permission to store, process, and display your content only as needed to provide the service to you. We don't use your content for advertising or sell it.
Your content may include personal information about your customers, such as names, email and shipping addresses, order details, and communications. You are responsible for having the right to share that information with us for dispute purposes, and for giving your customers any privacy notices the law requires. We handle that information only on your behalf and as described in our Privacy Policy.
You're solely responsible for the accuracy and legality of your content and of any response you submit using it.
9. Feedback
If you send us feedback or suggestions, we may use them to improve Disputivo without any obligation to you.
10. Plans and fees
Disputivo is currently free. A paid plan may be offered in the future. We will not charge you without first publishing the pricing and billing terms and getting your clear agreement to them.
11. Third-party services
Disputivo relies on third-party providers for hosting, database, file storage, authentication, analytics, and error monitoring (listed in our Privacy Policy). We aren't responsible for outages or failures of services we don't control.
12. Disclaimers
The service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the service will be uninterrupted, secure, or error-free, that data will not be lost, or that any dispute will have a particular outcome.
13. Limitation of liability
To the fullest extent permitted by law, Disputivo will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost data, or lost or denied disputes or chargebacks, arising from or related to your use of the service, even if we were told such damages were possible.
To the fullest extent permitted by law, our total liability for all claims arising from or related to the service is limited to the greater of (a) the amount you paid us for the service in the 12 months before the claim arose, or (b) one hundred U.S. dollars ($100).
Some jurisdictions don't allow certain of these limitations, so some of them may not apply to you.
14. Indemnification
You agree to defend and indemnify Disputivo against any third-party claim, loss, or expense (including reasonable attorneys' fees) arising from your content, your use of the service, any response or evidence you submit to a card network, bank, or payment processor, or your violation of these terms or of the law.
15. Termination
You may stop using the service at any time, delete your disputes from the dashboard, and request deletion of your account through the contact details above. We may suspend or terminate accounts that violate these terms or that create legal or security risk. Sections 7, 8, 12, 13, 14, and 17 continue to apply after termination.
16. Changes to these terms
We may update these terms as the product changes. If we make a material change, we'll notify you by email or in the dashboard before it takes effect. Continuing to use the service after a change takes effect means you accept the updated terms.
17. Governing law and disputes
These terms are governed by the laws of the State of California, without regard to its conflict of law principles. If a disagreement arises, please contact us first so we can try to resolve it informally. If it can't be resolved within 30 days, any lawsuit must be brought in the state or federal courts located in Orange County, California, and you and Disputivo consent to the jurisdiction of those courts.
18. General
These terms and our Privacy Policy are the entire agreement between you and Disputivo about the service. If any part of these terms is found unenforceable, the rest stays in effect. Our not enforcing a provision isn't a waiver of it. You may not transfer these terms without our consent; we may transfer them in connection with a sale or reorganization of the business.
